    If you’re staring at a 3.5-, 7.5-, or 11.5-year payment and thinking, “Do we pay this… or let it go?” you’re really asking a sharper question:

    Does this patent have real value today—even if the original business doesn’t?

    That question used to be slow and expensive to answer. AI changes that. But it also changes the risk profile for patent practitioners—especially if we rely on non-dedicated tools past the point where “signal” becomes “opinion.”
    Here’s the story that made that distinction real for me.

    A quiet email, a loud decision

    It arrived like any other docket notice:

    “7.5-Year Maintenance Fee Due.”

    The patent number was familiar. The client name was from years ago. We hadn’t spoken in a long time—because the startup didn’t work out, the partners moved on, and the patent became one of those “maybe someday” assets that quietly sit until the clock forces a decision.
    This is where many patents die—not because they’re worthless, but because the cost of figuring out value feels higher than the upside.
    And in the old days, that was often rational.
    A proper market scan and infringement-style diligence can take hours (or days). By the time you’ve reviewed candidates, pulled documentation, and mapped features to claim limitations, you’ve already spent enough that abandoning feels inevitable.

    So I tried a different approach.

    General AI: fast scouting, fast structure

    I opened a general-purpose AI model.
    Not to “do infringement.” Not to produce an opinion. Not to generate anything I wouldn’t be comfortable explaining to a client or defending in writing.
    I used it as a scout.

    I gave it public inputs only (patent number, published claim language, and publicly known context) and framed a tight prompt:

    • Where would this claim scope show up in today’s market?
    • Which product categories are most likely to implement it?
    • What keywords and feature descriptions should I verify?
    • Which companies are plausible candidates—and why?

    Within minutes, I had something that would have taken me hours to assemble manually:

    • a structured list of market segments,
    • a shortlist of candidate product families,
    • a set of “evidence trails” to follow (docs, manuals, API references, marketing language, job postings).

    Some suggestions were noise. A few were wrong. But a handful were the kind of “interesting” that changes your posture—because you can see a credible path to validation.
    And when I followed those threads, I found smoke.
    Not courtroom-grade proof. Not a claim chart. Not a conclusion.
    But enough of a signal to justify the next step: this patent might be alive in the market even if the startup wasn’t.

    The line I won’t cross with general models

    At that moment, it’s tempting to stop and declare victory:
    “There are likely infringers—pay the fee.”
    That’s also the moment a practitioner can accidentally step into professional risk.

    Because general models are optimized to be helpful and fluent—not to be:

    • claim-chart disciplined,
    • evidence-grounded by default,
    • auditable and reproducible,
    • safe-by-design for confidential workflows.

    In patent practice, the danger isn’t that AI is “bad.” The danger is how easy it becomes to sound certain without doing the work required to be certain.

    So I adopted a simple rule that I now repeat in every internal discussion:

    General models scout; dedicated IP tools substantiate.
    General models find doors; dedicated workflows prove what’s behind them.

    I use that line twice on purpose—because it’s the difference between responsible acceleration and expensive overreach.

    Dedicated IP AI tools: not “smarter,” just safer when the stakes rise

    Most “dedicated” IP AI tools aren’t magical because they have a secret super-model.

    They win because they wrap AI inside what patent work actually requires:

    • Structured outputs (claim charts, support mapping, issue lists)
    • Workflow constraints (consistent terminology, dependency management, change tracking)
    • Grounding (citations to sources, traceability of what was relied on)
    • Governance (audit logs, access controls, retention policies, tenant separation—depending on vendor)

    In other words: dedicated tools don’t just generate text. They generate reviewable work product.

    That’s why the same maintenance-fee situation looks different depending on the tool:

    • A general model helps you quickly produce a credible hypothesis map: where to look and what to check.
    • A dedicated IP tool/workflow helps you turn that hypothesis into a defensible decision packet: what we found, what we verified, what we didn’t, and what it implies.

    When money is on the line—maintenance, licensing, enforcement—that difference matters.

    What I actually do now (the workflow)

    Here’s the approach I recommend when the question is “pay the fee or walk away”:

    1) Public triage scan (general model)

    • Use only public inputs.
    • Generate market hypotheses, search terms, candidate categories.
    • Treat output as leads, not conclusions.

    2) Shortlist validation (human + evidence)

    • Pull primary public sources (product docs, manuals, specs, releases).
    • Confirm whether key claim elements plausibly appear.

    3) Claim-chart mapping (dedicated workflow)

    • Build a structured chart (features → claim limitations → evidence).
    • Explicitly flag what is proven vs unproven.

    4) Decision packet

    • A clear recommendation: pay / don’t pay / pay and investigate further.
    • Business framing: cost vs upside, timelines, likely next steps.

    This is where AI shines: it compresses time-to-clarity without pretending that clarity appears by itself.

    The conclusion I’ve earned the hard way

    AI makes it possible to rescue patents that would otherwise be abandoned by inertia.
    That’s good for inventors. It’s good for portfolios. It’s good for business outcomes.
    But here’s the practical boundary that keeps the upside without importing unnecessary risk:

    Use general models for scouting. Use dedicated IP tools (or dedicated, governed workflows) when the work needs to be defensible.

    If all you need is a fast signal to decide whether a maintenance fee is worth another look, a general model—used carefully—can be enough.
    If the signal is positive and the upside is real, don’t validate it with a vibe.
    Validate it with structure, evidence, and a workflow designed for patent work.
    Because in IP, the question isn’t whether you can generate an answer quickly.
    It’s whether you can stand behind it when it matters.
